It became known that the Saratov Regional Court overturned the decision of the Saratov District Court to restrict access to the Tor Project in Russia. As a result, the case was sent back for retrial. About it reported TASS news agency with reference to the press service of the court.
Earlier, Roskomnadzor, on the basis of a court decision, restricted access to the Tor Project resource in the country, and the site itself was included in the register of prohibited information. The reason for blocking the site was the information posted on it regarding the means that provide access to illegal content. The appeal says that the owner of the resource did not participate in the consideration of the case, on the basis of which it was proposed to cancel the court decision.
According to available information, the Saratov Regional Court overturned the decision of the first instance due to a violation of procedural law and sent the case back for retrial. “In the course of preparing an administrative case for trial, the judge must determine the circle of other persons whose rights and legitimate interests may be affected by the court decision (for example, owners of Internet sites, authors of information posted on them). If such persons are identified, their location (place of residence) is established, the court shall involve them in the case, notify them of the time and place of the court session.– said the representative of the press service of the court.
