In order to protect customers from unsafe electronic products, the Federal Network Agency controls many offers. According to the Federal Network Agency, more than 21 million electronic devices were taken out of service in 2020 alone. Again and again there are products with missing or counterfeit CE marking, so that these products can be potentially dangerous. Negotiators from the EU Parliament and the member states have now agreed on stricter consumer protection rules. For example, dangerous products should be taken off the market more quickly.
Amazon & Co. must remove defective products from the range within two working days
In future, the manufacturer information on EU safety standards must be checked for accuracy by a responsible contact person. If damage occurs due to defective products, this named person is liable. Until now, it was theoretically possible to import products into the EU from a non-EU country with a counterfeit CE marking. After all, only the national supervisory authority took care of the goods, now there is another testing authority. Defective products must be removed from the online offer within two working days if this has been ordered by customs, for example. Amazon & Co. will have to make reasonable efforts to randomly search for dangerous products.
Buyers can enjoy a longer warranty period by being entitled to exchange, repair or refund the purchase price of dangerous products. In the event of recall campaigns relating to product safety, online retailers will in future be obliged to inform all affected customers and at the same time to avoid derogatory expressions such as voluntary or precautionary. The European Parliament and the EU states must formally agree to the regulations. Once this is done, the new rules will apply with a transitional period of 18 months.
