This week, Microsoft’s response to the FTC (US Federal Trade Commission) claims was published, in which the American corporation once again noted that the merger with Activision Blizzard would definitely benefit the gaming industry and competition. In the Microsoft document, Paragraph answers all claims by the FTC and Sony.
There is another interesting detail in this document – Microsoft actually accuses the FTC of illegal actions. An American corporation believes that the FTC is violating the Constitution with its administrative lawsuit to prevent Microsoft from merging with Activision Blizzard. In Microsoft’s FTC response on page 34, the corporation claims that the FTC’s approach to the Activision Blizzard merger is unconstitutional and violates Articles II, III and their right to equal protection under the Fifth Amendment.
Recall that if the parties fail to reach an agreement by August, a trial will begin, where it will be established whether the FTC was really guided by competition issues when it wanted to block the deal.
