The Cabinet of Ministers has approved a list of criteria by which an enterprise can be defined as “critical”, which means that such employees will be able to receive a respite from mobilization. The Ministry of Digital Development, in turn, published the algorithm by which the booking will be made.
According to the Deputy Chairman of the Ministry of Digital Transformation of Ukraine Oleksandr Bornyakov, “Critical” enterprises will be able to book up to 50% of military service workers from their number on the date of submission of the list – and heads of enterprises and their deputies are subject to reservation regardless of age, military rank and military specialty.
Algorithm for booking employees of enterprises
Apply for the recognition of the enterprise as “critical” to the Ministry of Digital Development, which will check it for compliance with the criteria; If an enterprise is recognized as “critical”, it must provide the Ministry of Digital Investigation with a letter of justification and a list of those liable for military service, which will later be agreed with the General Staff; The Ministry of Economy will issue a booking order, and the enterprise will organize the issuance of an extract to employees; Once a quarter, the enterprise reports to the Ministry of Digital Transformation on the number of persons liable for military service.
The Cabinet of Ministers also adopted a resolution allowing Diya.City residents to employ foreigners and stateless persons without a work permit. Cooperation on such conditions is possible only through the conclusion of a GIG contract with a specialist. The very same benefit will be valid until the end of martial law.

Recall that the main criteria by which an enterprise is determined to be critical for the functioning of the country’s economy are:
the enterprise is a resident of Diya City; the total amount of taxes, fees, payments accrued, withheld and paid to the state and local budgets, except for customs payments, during the reporting tax year exceeds the equivalent of €1.5 million; the amount of receipts in foreign currency, except for credits and loans, for the reporting tax year exceeds the equivalent of €32 million; companies are of strategic importance for the country’s economy and security; enterprises are important for the sector of the national economy or meeting the needs of the territorial community; absence of arrears in the payment of a single contribution for compulsory state social insurance; the average salary of insured employees at the enterprise for the last calendar quarter is not less than the average salary in the region for the reporting period.
To be considered “critical”, an enterprise must meet at least 3 criteria.
Also, critical enterprises include: UN specialized agencies, foreign diplomatic institutions in Ukraine, representative offices of donor agencies, executors of international technical assistance projects, representative offices of international organizations, international and Ukrainian non-governmental organizations implementing projects at the expense of international partners.
Earlier, the head of the Ministry of Economy of Ukraine, Yulia Sviridenko, announced that the Cabinet of Ministers would allow Ukrainians who received reservations from the draft to go on business trips abroad.
