Chronology of Events Recorded on CCTV
As reported by NBC News, the incident began on February 21, 2023 at Matanzas High School, north of Daytona Beach. The incident began when Joan Naydich, a teacher at the school, confiscated Brendan Depa’s Nintendo Switch.
Not accepting his Switch being confiscated, Brendan attacked the teacher and knocked him to the floor. A video recording shows the incident where Brendan beat the teacher by hitting and kicking him repeatedly until the teacher was unconscious.
After several times of beating, the perpetrator was finally pulled away from the victim by people around the incident. And in court, Joan Naydich said that she suffered from PTSD and also high anxiety due to the attack. She also admitted that she did not confiscate Brendan’s Nintendo Switch.
Joan Nayditch also said that her life will never be the same as it was because of this attack because the incident will be completely embedded in her mind. Meanwhile, Brendan Depa in addition to getting a 5-year prison sentence also received 15 years of probation.

Immediately Arrested During the Incident
At the same hearing, Brendan Depa’s mother, Leanne Depa, testified that her son had mental health issues and was triggered by the confiscation of his electronic device, namely the Nintendo Switch.
The evaluation of the trial itself found that Brendan Depa had autism and several other conditions, but he was still able to stand in court.
The mother said that her child needed help, and she needed care. And the mother also defended her child by saying that her child should not be put in prison because then her child would be used or even hurt.
According to the mother, her son’s school failed to follow the individual education program aimed at helping children with special needs. This is also what led Brendan Depa’s family to sue the school this year.
Nintendo Switch Confiscated
The lawsuit alleges the school failed to provide the child with adequate support and assisted in the attack. The school has not commented on the allegations.
Currently, Brendan Depa has been officially sentenced to 5 years in prison and 15 years probation. Meanwhile, the trial of the lawsuit against the school by his mother has not been determined.
