Sony and Microsoft are also seeking the dismissal of a class-action lawsuit over refunds to buyers of PlayStation 5 and Xbox series consoles. Denying refunds is important to the industry because it reflects a company’s right to retain revenue from tariff-related price increases.
Nintendo filed a similar petition this summer. Lawyers for the company said consumers purchased the items voluntarily and received what they paid for. Now, competitors are opting for a similar line of defense. Sony representatives said accusations that tariffs were related to the PS5 price increase in August are purely speculative and illogical. They stressed that further increases in costs following the removal of tariffs refuted the plaintiffs’ claims.
Microsoft is also seeking to have the case dismissed through the courts. The company’s lawyers said that the purchase of the game system at the specified price was not a loss and that the transaction itself was completely fair. Litigation continues, but the chances of recovering some of the money through the courts remain slim.
