Anthropic calls active users the core of its business. However, some customers believe the company is deceiving them. In a class-action lawsuit filed today, a group of Cloud subscribers claim the company used misleading advertising when describing Max plan limits. Users accuse Anthropic of maximizing profits at the expense of users.

Claude’s Max plan is an upgrade from the Pro plan and costs $20 per month. It offers two payment options: $100 per month for usage over 5x the Pro limit, or $200 per month for 20x the usage limit. The lawsuit alleges that the numbers appeared in Anthropic’s promotional materials with misleading fine print explanations. The limit increases promised by the company only apply in five-hour intervals and are subject to weekly limits. According to the plaintiffs, this ended up providing a much smaller increase in available usage than Anthropic had promised.

Complaints about the maximum tariff conditions have appeared online. One Reddit user wrote: “The pricing page makes it look like you’re purchasing a specific weekly usage limit. However, in reality, operating capacity is determined by a sliding five-hour window… It’s like putting a larger gas tank in your car but limiting the fuel pump to a gallon for five hours.”
Over the past year, all major artificial intelligence services have faced increasing pressure from investors who want to see a return on their investment. Customers are increasingly complaining that leading developers are passing on high operating costs to them. Although Anthropic announced plans for Max in April 2025, weekly limits were not implemented until several months later. In a description of its latest model, the Fable 5.1, the company noted that when pricing the new model “Taking into account user feedback on pricing.”
The complaint was originally filed in July but was later withdrawn and refiled as an expanded class action lawsuit. In its motion to dismiss the original lawsuit, Anthropic argued that information about session limits was not withheld from consumers. “To access this clarifying information… all you have to do is click on the link available during the purchase process – the equivalent of turning the product over and reading the label on the back.”said the human.
The plaintiff’s lawyer said that understanding the situation is not that simple: “Consumers must rely on sellers’ representations. They cannot verify this information. They cannot know exactly what they will get…In fact, they act at their own risk and rely on the fairness of the market.” Even if the relevant terms and conditions are stated somewhere on the Anthropic website, consumers should not search for them on their own.
