Nintendo has scored another legal victory in Europe: The District Court of The Hague (Rechtbank Den Haag) outlawed the sale of devices that bypass the console’s security mechanisms, e.g. MIG switch card and MIG switch dump truck. The lawsuit was filed against an online seller who sold the cartridges directly from Asia through a website.
The court ruled that such devices were copyright infringements and were created solely to run pirated games, in complete violation of European law. Nintendo directly cited a similar landmark decision in 2010 for sellers of Nintendo DS R4 cartridges. In an official statement, the company warned players of the dangers of using such mods, which could harm the console ecosystem and undermine the work of independent developers.
