
Take-Two Interactive (including publishers 2K and Rockstar) and Microsoft concluded a new long-term Publish the agreement for the Xbox project. The document was signed on September 28, 2026 and will take effect retroactively from September 17, replacing the previous agreement between the two companies.
The agreement gives Take-Two the rights to develop, publish, manufacture, market, distribute and sell products compatible with all Xbox devices. The document separately spells out commercial terms for digital content, including wholesale prices and revenue splits, as well as fees and royalties on sales of physical copies.
Microsoft reserves the right to approve product concepts and marketing materials using its trademarks. The document also sets out standard conditions for the termination of cooperation, for example in the event of serious breaches of the contract or in the event that one party is unable to fulfill its obligations. In addition, it also stipulates Take-Two’s ability to sell remaining physical copy inventory after the completion or termination of the agreement. In other words, the new conditions apply not only to digital distribution, but also to physical distribution.
Take-Two noted that they view this agreement as the basis for a long-term partnership with the Xbox platform. The new plan formalizes the economic and operational conditions for the company’s projects, as well as procedures for interacting with Microsoft when launching and promoting products. The agreement covers all Xbox devices; we’re talking about a long-term relationship between the companies, rather than being tied to a specific generation of consoles. However, the document does not reveal the specific project or its release date.
Please note that entering into such agreements is standard practice between large publishing houses and platform holders. In most cases, within the framework of such agreements, separate commission conditions are established when distributing games in specific stores, but figures for Take-Two’s conditions were not given in the announcement.
